Decreto n.º 8/2010
de 27 de Abril
Considerando as boas relações entre a República Portuguesa
e a Ucrânia e tendo em conta que ambos os Estados
reconhecem a importância do reforço das relações de amizade
e cooperação existentes, foi assinada a Convenção
sobre a Segurança Social.

A Convenção resulta da necessidade de coordenação das

medidas de segurança social, e pretende garantir a igualdade
de tratamento no acesso e na concessão de prestações
que decorram directamente da aplicação da legislação que
vigora em cada um dos Estados. Assim, estabelecem -se
condições de igualdade para os trabalhadores nacionais
de uma das Partes Contratantes residentes em território
da outra Parte Contratante, estende -se a sua aplicação aos
apátridas ou refugiados residentes no território de um dos
Estados Contratantes e aos familiares e sobreviventes dos
trabalhadores residentes em território de uma das Partes
Contratantes.
A igualdade de tratamento é concretizada pelo benefício
dos direitos e cumprimento dos deveres previstos na legislação
de cada uma das Partes Contratantes, nas mesmas
condições que os nacionais do respectivo Estado.
A presente Convenção aplica -se, no que respeita a Portugal,
ao sistema de segurança social, aos regimes aplicáveis
à generalidade dos trabalhadores por conta de outrem e aos
trabalhadores independentes, bem como aos regimes de
inscrição facultativa do sistema previdencial relativamente
a prestações nas eventualidades de doença, maternidade,
paternidade, adopção, doenças profissionais, desemprego,
invalidez, velhice e morte. Aplica -se ainda ao regime de
reparação dos danos emergentes dos acidentes de trabalho e
ao regime relativo às prestações por encargos familiares do
subsistema de protecção familiar do sistema de protecção
social de cidadania
No que respeita à Ucrânia, a Convenção aplica -se à respectiva
legislação nacional de protecção de eventualidades
de entre as acima referidas.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição,
o Governo aprova a Convenção sobre Segurança
Social entre a República Portuguesa e a Ucrânia, assinada
em Lisboa em 7 de Julho de 2009, cujo texto, nas versões
autenticadas nas línguas portuguesa, ucraniana e inglesa,
se publica em anexo.

CONVENÇÃO SOBRE SEGURANÇA SOCIAL
ENTRE A REPÚBLICA PORTUGUESA E A UCRÂNIA
A República Portuguesa e a Ucrânia, adiante designadas
por «Estados Contratantes»;
Animadas pelo desejo de desenvolver as suas relações
no domínio da segurança social;
Consagrando os princípios da igualdade de tratamento
e da determinação da legislação aplicável com vista a garantir
os direitos adquiridos e em curso de aquisição dos
respectivos nacionais:
Acordam no seguinte:
TÍTULO I
Disposições gerais
Artigo 1.º
Definições
1 — Para os efeitos de aplicação da presente Convenção:
a) O termo «território» designa:
i) Relativamente à República Portuguesa, o território
no continente europeu e os arquipélagos dos Açores e da
Madeira;
ii) Relativamente à Ucrânia, o território dentro dos limites
das fronteiras existentes;
b) O termo «nacional» designa a pessoa considerada
como tal pela legislação dos Estados Contratantes;
c) O termo «refugiado» tem o significado que lhe é
atribuído no artigo 1.º da Convenção Relativa ao Estatuto
dos Refugiados, adoptada em Genebra em 28 de Julho
de 1951, e no n.º 2 do artigo 1.º do Protocolo Adicional à
Convenção Relativa ao Estatuto dos Refugiados, adoptado
em Nova Iorque em 31 de Janeiro de 1967;
d) O termo «apátrida» tem o significado que lhe é atribuído
no artigo 1.º da Convenção Relativa ao Estatuto dos Apátridas,
adoptada em Nova Iorque em 28 de Setembro de 1954;

e) O termo «trabalhador» designa o trabalhador por
conta de outrem ou independente abrangido pelos regimes
referidos no artigo 4.º da presente Convenção;
f) O termo «membro da família» designa qualquer pessoa
definida ou reconhecida como tal pela legislação nos
termos da qual as prestações são devidas;
g) O termo «sobrevivente» designa qualquer pessoa
definida como tal pela legislação nos termos da qual as
prestações ou pensões por sobrevivência são devidas;
h) O termo «residência» designa o lugar onde a pessoa
reside habitualmente;
i) O termo «estada» designa o lugar onde a pessoa reside
temporariamente;
j) O termo «legislação» designa as leis e outros actos
normativos em vigor respeitantes aos regimes ou sistemas
referidos no artigo 4.º da presente Convenção;
l) A expressão «autoridade competente» designa:
i) Relativamente à República Portuguesa, o membro
ou membros do Governo ou qualquer outra autoridade
correspondente, responsável pelas matérias referidas no
artigo 4.º da presente Convenção, relativamente ao conjunto
ou a uma parte do seu território;
ii) Relativamente à Ucrânia, o órgão central do poder
executivo, do âmbito do trabalho e da política social, expressamente
autorizado;
m) A expressão «instituição competente» designa:
i) Relativamente à República Portuguesa, a instituição
em que a pessoa está inscrita na data do pedido das
prestações, ou a instituição relativamente à qual a pessoa
tem ou teria direito a prestações se residisse no território
do Estado Contratante onde se situa essa instituição, ou a
instituição designada pela autoridade competente do Estado
Contratante em causa;
ii) Relativamente à Ucrânia, a instituição ou instituições
que concedem as prestações ou pensões devidas a título
da legislação em vigor, mencionada na alínea b) do n.º 1
do artigo 4.º da presente Convenção;
n) A expressão «instituição do lugar de residência» designa
a instituição com poderes para conceder as prestações
no lugar onde o interessado reside, nos termos da legislação
aplicada por essa instituição, ou, se tal instituição não
existir, a instituição designada pela autoridade competente
do Estado Contratante em causa;
o) A expressão «instituição do lugar da estada» designa
a instituição com poderes para conceder as prestações no
lugar onde o interessado se encontra temporariamente,
nos termos da legislação aplicada por essa instituição, ou,
se tal instituição não existir, a instituição designada pela
autoridade competente do Estado Contratante em causa;
p) A expressão «Estado competente» designa o Estado
Contratante em cujo território se encontra a instituição
competente;
q) A expressão «períodos de seguro» designa os períodos
de contribuição, de emprego ou de actividade não assalariada
definidos ou considerados como períodos de seguro
pela legislação nos termos da qual foram cumpridos, bem
como quaisquer períodos equiparados, na medida em que
sejam considerados por essa legislação como equivalentes
a períodos de seguro;
r) Os termos «prestações» e «pensões» designam quaisquer
prestações, incluindo, designadamente, os elementos
que as complementem, assim como as melhorias, acréscimos
de actualização ou subsídios complementares e
as prestações em capital que as substituam, de acordo
com o previsto na legislação de cada Estado Contratante;
s) A expressão «subsídios por morte» designa qualquer
abono ou quantia paga de uma só vez em caso de morte,
excluindo as prestações em capital referidas na alínea r)
do n.º 1 do presente artigo, de acordo com o previsto na
legislação de cada Estado Contratante.
2 — Outros termos e expressões utilizados na presente
Convenção têm o significado que lhes é atribuído pela
legislação aplicável.
Artigo 2.º
Âmbito de aplicação pessoal
A presente Convenção aplica -se às pessoas que estão
ou estiveram sujeitos às legislações referidas no artigo 4.º
e que sejam nacionais de um dos Estados Contratantes,
apátridas ou refugiados residentes no território de um destes
Estados Contratantes, bem como aos seus familiares e
sobreviventes, e a todas cujos direitos derivem daquelas.
Artigo 3.º
Princípio da igualdade de tratamento
Sem prejuízo do disposto na presente Convenção, as
pessoas referidas no artigo 2.º que residam no território
de um Estado Contratante beneficiam dos direitos e estão
sujeitos às obrigações previstos na respectiva legislação,
nas mesmas condições que os nacionais deste Estado Contratante.
Artigo 4.º
Âmbito de aplicação material
1 — A presente Convenção aplica -se:
a) Em Portugal, às legislações relativas:
i) Aos regimes de segurança social aplicáveis à generalidade
dos trabalhadores por conta de outrem e aos
trabalhadores independentes e aos regimes de inscrição
facultativa do sistema previdencial do sistema de segurança
social, no que respeita às prestações nas eventualidades
de doença, maternidade, paternidade e adopção, doenças
profissionais, desemprego, invalidez, velhice e morte;
ii) Ao regime aplicável às prestações por encargos familiares
do subsistema de protecção familiar do sistema
de protecção social de cidadania;
iii) Ao regime de reparação dos danos emergentes dos
acidentes de trabalho;
b) Na Ucrânia, às legislações relativas aos regimes dos
seguros sociais aplicáveis em relação a:
i) Às legislações sobre os seguros sociais nas eventualidades
de doença (incapacidade temporária para o trabalho);
gravidez e parto (maternidade); subsídio de funeral;
acidentes de trabalho, doenças profissionais e ou morte
provocada por estas causas; desemprego; pensão por idade,
por invalidez, por perda do sustento da família e por tempo
de serviço, de acordo com a legislação sobre seguros públicos
obrigatórios em matéria de pensões;
ii) À legislação relativa às prestações públicas para
famílias com crianças nas situações de nascimento da
criança e cuidados até aos 3 anos de idade.
2 — A presente Convenção aplica -se igualmente a todas
as leis e outros actos normativos que modifiquem e completem
as legislações referidas no n.º 1 do presente artigo.
3 — Todavia, apenas se aplica:
a) Às leis e outros actos normativos que abranjam um
novo ramo da segurança social, se for estabelecido um
acordo, para este efeito, entre os Estados Contratantes;
b) Às leis e outros actos normativos que estendam os
regimes existentes a novas categorias de beneficiários,
mediante notificação, por escrito, ao outro Estado Contratante
no prazo de três meses a contar da data da publicação
oficial desses actos.
4 — A presente Convenção não se aplica à assistência
social nem, sem prejuízo do disposto no n.º 8 do artigo 9.º:
a) Na República Portuguesa, aos regimes especiais dos
funcionários públicos e do pessoal equiparado;
b) Na Ucrânia, às pensões fixadas por legislação especial
e financiadas pelo Orçamento Estatal da Ucrânia.
Artigo 5.º
Admissão ao seguro social voluntário ou facultativo continuado
1 — Para efeitos de admissão ao seguro social voluntário
ou facultativo continuado, em conformidade com a
legislação de um Estado Contratante, os períodos de seguro
cumpridos nos termos da legislação do outro Estado
Contratante são totalizados, se necessário, desde que não
se sobreponham.
2 — O disposto no n.º 1 do presente artigo apenas é
aplicável à pessoa que não possa beneficiar do seguro
obrigatório nos termos da legislação de qualquer dos Estados
Contratantes.
Artigo 6.º
Condições de residência
1 — Sem prejuízo do disposto no título III da presente
Convenção, as prestações por doença, maternidade, paternidade
e adopção, por invalidez, por tempo de serviço,
velhice, sobrevivência ou perda do sustento de família,
bem como as prestações por acidente de trabalho ou doença
profissional e morte resultante destas causas, e ainda os
subsídios por morte, adquiridos nos termos da legislação
de um Estado Contratante são pagos directamente aos
interessados, mesmo que residam no território do outro
Estado Contratante.
2 — As prestações previstas no n.º 1 do presente artigo
não podem sofrer qualquer redução, suspensão ou
supressão pelo facto de o interessado residir no território
do outro Estado Contratante.
Artigo 7.º
Regras anticúmulo
1 — A presente Convenção não pode conferir nem
manter o direito ao benefício, nos termos das legislações
dos Estados Contratantes, de várias prestações da mesma
natureza.
2 — O disposto no n.º 1 do presente artigo não se aplica
às prestações liquidadas em conformidade com o disposto
nos artigos 15.º e 16.º da presente Convenção.
3 — As cláusulas de redução, de suspensão ou de supressão
previstas na legislação de um Estado Contratante,
no caso de cumulação de uma prestação com outras prestações
ou com outros rendimentos, incluindo os decorrentes
de exercício de uma actividade profissional, são oponíveis
ao beneficiário, ainda que se trate de prestações adquiridas
nos termos da legislação do outro Estado Contratante ou
de rendimentos obtidos no território deste último Estado
Contratante.
TÍTULO II
Disposições relativas à determinação da legislação
aplicável
Artigo 8.º
Regra geral
Sem prejuízo do disposto nos artigos 9.º a 11.º, os trabalhadores
que exercem uma actividade profissional no
território de um Estado Contratante estão sujeitos à legislação
desse Estado Contratante, mesmo que residam ou
que a empresa ou a entidade patronal que as emprega tenha
sede ou domicílio no território do outro Estado Contratante.
Artigo 9.º
Regras especiais
1 — O trabalhador que exerça uma actividade assalariada
no território de um Estado Contratante ao serviço
de uma empresa, de que normalmente depende, e que seja
destacado por essa empresa para o território do outro Estado
Contratante, para aí efectuar um determinado trabalho
por conta dessa empresa, continua sujeito à legislação do
primeiro Estado Contratante desde que a duração previsível
do trabalho não exceda 12 meses e que não seja enviado
em substituição de outra pessoa que tenha terminado o seu
período de destacamento.
2 — Se, devido a circunstâncias imprevisíveis, a duração
do trabalho referido no n.º 1 do presente artigo se prolongar
para além do prazo inicialmente previsto, a legislação do
primeiro Estado Contratante continua a aplicar -se durante
um período máximo de 12 meses, mediante acordo prévio
da autoridade competente ou do organismo designado por
essa autoridade do outro Estado Contratante.
3 — O trabalhador que exerça uma actividade assalariada
no território de um Estado Contratante e uma
actividade não assalariada no território do outro Estado
Contratante fica sujeito à legislação do primeiro Estado
Contratante.
4 — O trabalhador que exerça uma actividade não assalariada
no território de um Estado Contratante e que efectue
uma prestação de serviços por conta própria no território
do outro Estado Contratante e desde que essa actividade
tenha uma relação directa com a que habitualmente exerce
fica sujeito à legislação do primeiro Estado Contratante,
desde que essa prestação de serviços não exceda seis meses.
5 — O trabalhador que faça parte da equipagem ou da
tripulação de uma empresa que efectue por conta própria
ou por conta de outrem transportes internacionais de passageiros
ou de mercadorias, por via terrestre, aérea ou
navegável, ou de uma empresa de pesca marítima, fica
sujeito à legislação do Estado Contratante em cujo território
se situa a sede da empresa, seja qual for o Estado
Contratante em cujo território resida.
6 — O trabalhador que faça parte da tripulação de um
navio que arvore a bandeira de um Estado terceiro fica
sujeito à legislação do Estado Contratante em cujo território
se situa a sede da empresa ou, não tendo a empresa
sede em qualquer dos Estados Contratantes, à legislação
do Estado Contratante em cujo território a empresa tenha
uma sucursal ou qualquer outra representação permanente.
7 — O trabalhador que esteja ocupado com a carga, descarga,
reparação ou vigilância a bordo de um navio pertencente
a uma empresa que tenha sede no território de um
Estado Contratante, e que não integre a equipagem ou a
tripulação desse navio, durante a permanência do navio nas
águas territoriais ou num porto do outro Estado Contratante,
fica sujeito à legislação deste último Estado Contratante.
8 — Os funcionários públicos e os trabalhadores ao
serviço do Estado que sejam enviados de um Estado Contratante
para o outro continuam sujeitos à legislação do
primeiro Estado Contratante.
Artigo 10.º
Regras especiais aplicáveis ao pessoal
das missões diplomáticas e postos consulares
1 — O pessoal das missões diplomáticas e dos postos
consulares está sujeito ao disposto na Convenção sobre
Relações Diplomáticas, adoptada em Viena em 18 de Abril
de 1961, e na Convenção sobre Relações Consulares, adoptada
em Viena em 24 de Abril de 1963, sem prejuízo do
disposto nos n.os 2 e 3 do presente artigo.
2 — O pessoal administrativo e técnico e o pessoal de
serviço das missões diplomáticas ou postos consulares
dos Estados Contratantes, bem como os trabalhadores
domésticos que estejam ao serviço pessoal de agentes
daquelas missões ou postos, que não tenham a qualidade
de funcionários públicos, estão sujeitos à legislação do
Estado Contratante em cujo território exercem actividade.
3 — Os trabalhadores referidos no n.º 2 do presente
artigo que sejam nacionais do Estado Contratante representado
pela missão diplomática ou posto consular em causa
podem optar pela aplicação da legislação desse Estado
Contratante, podendo fazê -lo uma única vez, no prazo de
um ano, a contar da data de entrada em vigor da presente
Convenção, ou no prazo de seis meses, a contar da data
do início dessa actividade, conforme o caso.
Artigo 11.º
Excepção às regras dos artigos 8.º a 10.º
As autoridades competentes dos Estados Contratantes
ou os organismos por elas designados podem estabelecer,
de comum acordo e no interesse de determinados
trabalhadores ou categoria de trabalhadores, excepções
ao disposto nos artigos 8.º a 10.º da presente Convenção.
TÍTULO III
Disposições particulares relativas
às diferentes categorias de prestações
CAPÍTULO I
Doença e maternidade, paternidade
e adopção — Prestações pecuniárias
Artigo 12.º
Totalização de períodos de seguro
Para efeitos de aquisição, manutenção ou recuperação
do direito às prestações previstas neste capítulo, se um trabalhador
tiver estado sujeito sucessiva ou alternadamente
à legislação dos dois Estados Contratantes, os períodos
de seguro cumpridos nos termos da legislação de um dos
Estados Contratante são considerados pelo outro Estado
Contratante, se necessário e desde que não se sobreponham,
como se tivessem sido cumpridos ao abrigo da sua
legislação.
Artigo 13.º
Residência no Estado não competente
O trabalhador que resida no território do Estado Contratante
que não seja o Estado competente e que preencha
as condições exigidas pela legislação deste Estado Contratante,
tendo em conta, se for caso disso, o disposto no
artigo 12.º, beneficia das prestações no Estado Contratante
da residência.
Artigo 14.º
Cumulação do direito às prestações
No caso de a aplicação do presente capítulo conferir
a um trabalhador o direito ao benefício das prestações
por doença ou por maternidade, paternidade e adopção
ao abrigo das legislações dos dois Estados Contratantes,
é aplicada a legislação do Estado Contratante em cujo
território ocorreu o evento.
CAPÍTULO II
Prestações por invalidez, por velhice,
por sobrevivência, por tempo de serviço e por morte
SECÇÃO I
Pensões por invalidez, por velhice,
por sobrevivência e por tempo de serviço
Artigo 15.º
Totalização de períodos de seguro
1 — Para efeitos de aquisição, manutenção ou recuperação
do direito às pensões previstas nesta secção, se
um trabalhador tiver estado sujeito sucessiva ou alternadamente
à legislação dos dois Estados Contratantes, os
períodos de seguro cumpridos nos termos da legislação
de um dos Estados Contratantes são considerados pelo
outro Estado Contratante, se necessário e desde que não
se sobreponham, como se tivessem sido cumpridos ao
abrigo da sua legislação.
2 — Se a legislação de um Estado Contratante fizer
depender a concessão de determinadas pensões da condição
de os períodos de seguro serem cumpridos numa profissão
ou actividade abrangidas por um regime especial de segurança
social, apenas são tidos em conta para a concessão
dessas pensões os períodos cumpridos ao abrigo de um
regime especial correspondente do outro Estado Contratante
ou, na sua falta, na mesma profissão ou actividade.
3 — Se, tendo em conta os períodos cumpridos nos
termos do n.º 2 do presente artigo, o interessado não preencher
as condições necessárias para beneficiar dessas
pensões, tais períodos são tomados em consideração para
a concessão das pensões do regime geral.
4 — Para efeitos da aplicação do n.º 1 do presente artigo,
são tidos em conta os períodos de seguro cumpridos
nos termos da legislação de um Estado Contratante, que
não seja uma das legislações referidas no artigo 4.º, desde
que tenham sido considerados como períodos de seguro
nos termos de uma legislação abrangida pela presente
Convenção.
5 — Se, totalizando os períodos de seguro cumpridos
ao abrigo das legislações dos dois Estados Contratantes,
tal como previsto no presente artigo, não houver lugar à
abertura do direito a qualquer pensão, são tidos em conta
os períodos de seguro cumpridos ao abrigo da legislação
de um Estado terceiro ao qual ambos os Estados Contratantes
se encontrem vinculados por acordo internacional
de segurança social que preveja a totalização de períodos
de seguro.
Artigo 16.º
Cálculo e liquidação das pensões
1 — A instituição competente de cada Estado Contratante
determina se o interessado preenche as condições
para ter direito às pensões, tendo em conta, se necessário,
o disposto no artigo 15.º da presente Convenção.
2 — Caso o interessado preencha tais condições, aquela
instituição calcula o montante da pensão nos termos da
legislação por ela aplicada, directa e exclusivamente em
função dos períodos cumpridos ao abrigo dessa legislação.
3 — A instituição competente do Estado Contratante
que concede as pensões, nos termos do disposto no n.º 2
do presente artigo, tem exclusivamente em conta as remunerações
auferidas pelo interessado no território desse
Estado Contratante.
4 — Se a duração total dos períodos de seguro cumpridos
ao abrigo da legislação de um Estado Contratante não
atingir um ano e se, nos termos dessa legislação, não for
adquirido qualquer direito a pensões, tendo unicamente
em conta esses períodos, a instituição competente desse
Estado Contratante não fica obrigada a conceder pensões
em relação a esses períodos.
5 — Sem prejuízo do disposto no n.º 4 do presente artigo,
os períodos de seguro no mesmo referidos são tomados
em consideração pela instituição competente do outro
Estado Contratante como se tivessem sido cumpridos ao
abrigo da sua própria legislação.
6 — Se a soma das pensões a pagar pelas instituições
competentes dos dois Estados Contratantes não atingir o
montante mínimo estabelecido pela legislação do Estado
Contratante em cujo território reside o interessado, este
tem direito, durante o período em que aí residir, a um
complemento igual à diferença até à concorrência daquele
montante, a cargo da instituição competente do Estado
Contratante de residência.
SECÇÃO II
Subsídios por morte
Artigo 17.º
Totalização de períodos de seguro e concessão dos subsídios
1 — Para efeitos de aquisição, manutenção ou recuperação
do direito aos subsídios por morte, se o trabalhador
falecido tiver estado sujeito sucessiva ou alternadamente
à legislação dos dois Estados Contratantes, os períodos
de seguro cumpridos nos termos da legislação de um dos
Estados Contratantes são considerados pelo outro Estado
Contratante, se necessário e desde que não se sobreponham,
como se tivessem sido cumpridos ao abrigo da sua
legislação.
2 — Se a concessão do subsídio por morte, nos termos
da legislação de um Estado Contratante, estiver subordinada
à condição de que o falecimento tenha ocorrido no
respectivo território, esta condição considera -se preenchida
quando o falecimento tiver ocorrido no território do outro
Estado Contratante, ou de um Estado terceiro ao qual
ambos os Estados Contratantes se encontrem vinculados
por acordo internacional de segurança social, sem prejuízo
de disposições mais favoráveis previstas pela legislação
aplicada.
CAPÍTULO III
Prestações de desemprego
Artigo 18.º
Totalização dos períodos de seguro e concessão das prestações
1 — O trabalhador que se desloque do território de um
Estado Contratante para o território do outro Estado Contratante
tem direito, durante a permanência neste último
território, depois de aí ter estado ocupado, às prestações
de desemprego previstas na legislação deste Estado Contratante,
desde que sejam preenchidas as condições para a
concessão dessas prestações, tendo em conta, se necessário
e desde que não se sobreponham, os períodos de seguro
cumpridos nos termos da legislação do primeiro Estado
Contratante.
2 — A instituição competente do Estado Contratante
que concede as prestações de desemprego, nos termos do
disposto no n.º 1 do presente artigo, tem exclusivamente
em conta o salário recebido pelo interessado em relação
ao último emprego que exerceu no território desse Estado
Contratante.
CAPÍTULO IV
Prestações familiares
Artigo 19.º
Totalização de períodos de seguro
Para efeitos de aquisição, manutenção ou recuperação
do direito às prestações previstas neste capítulo, se o trabalhador
tiver estado sujeito sucessiva ou alternadamente
à legislação dos dois Estados Contratantes, os períodos
de seguro cumpridos nos termos da legislação de um dos
Estados Contratantes são considerados pelo outro Estado
Contratante, se necessário e desde que não se sobreponham,
como se tivessem sido cumpridos ao abrigo da sua
legislação.
Artigo 20.º
Concessão das prestações
1 — Os cidadãos portugueses que exercem actividade
profissional na Ucrânia e que se encontrem abrangidos pela
legislação ucraniana beneficiam, em relação aos familiares
que residam na Ucrânia, da prestação familiar pública nos
termos previstos nesta legislação, nas mesmas condições
que os nacionais ucranianos, desde que estejam preenchidas
as condições para a respectiva atribuição.
2 — Os cidadãos ucranianos que exercem actividade
profissional na República Portuguesa e que se encontrem
abrangidos pela legislação portuguesa beneficiam, em
relação aos familiares que residam na República Portuguesa,
do abono de família a crianças e jovens nos termos
previstos nesta legislação, nas mesmas condições que os
nacionais portugueses, desde que estejam preenchidas as
condições para a respectiva atribuição.
3 — O disposto nos n.os 1 e 2 do presente artigo aplica -se
igualmente aos titulares de pensão ou de renda.
4 — Se as prestações a que se referem os n.os 1 e 2 do
presente artigo não forem destinadas ao sustento dos membros
da família pela pessoa à qual devem ser concedidas,
a instituição competente concede as referidas prestações
directamente, com efeito liberatório, à pessoa singular ou
colectiva que efectivamente os tiver a cargo, mediante
pedido devidamente justificado.
CAPÍTULO V
Acidentes de trabalho e doenças
profissionais — Prestações pecuniárias
Artigo 21.º
Concessão das prestações
As prestações por acidente de trabalho e doença profissional
e ou morte deles resultante são concedidas pela
instituição competente do Estado Contratante por cuja
legislação o trabalhador está ou estava abrangido à data
do acidente de trabalho ou na data da ocorrência da doença
profissional ou da morte deles resultante, desde que
estejam preenchidas as condições exigidas pela legislação
desse Estado Contratante, tendo em conta, se necessário,
os períodos de seguro cumpridos nos termos da legislação
do outro Estado Contratante.
Artigo 22.º
Residência no Estado Contratante que não é o Estado competente
O trabalhador que resida no território do Estado Contratante
que não seja o Estado competente e que preencha
as condições exigidas pela legislação deste Estado Contratante,
tendo em conta, se necessário, os períodos de
seguro cumpridos nos termos da legislação do outro Estado
Contratante, beneficia das prestações por acidente de trabalho
e doença profissional de incapacidade temporária,
permanente ou morte no Estado Contratante de residência,
concedidas pelo Estado competente.
Artigo 23.º
Igualdade de tratamento de factos ocorridos
no Estado Contratante que não é o Estado competente
1 — Se, para avaliar o grau de incapacidade em caso
de acidente de trabalho ou doença profissional, a legislação
de um Estado Contratante tomar em consideração os
acidentes de trabalho e doenças profissionais ocorridos
anteriormente, são igualmente tomados em consideração
aqueles que tenham ocorrido ao abrigo da legislação
do outro Estado Contratante como se tivessem ocorrido
nos termos da legislação do primeiro Estado Contratante.
2 — Se a concessão das prestações por doença profissional,
nos termos da legislação de um Estado Contratante,
estiver subordinada à condição de que a doença em causa
tenha sido clinicamente diagnosticada pela primeira vez
no seu território, esta condição considera -se preenchida
quando a doença tiver sido diagnosticada pela primeira
vez no território do outro Estado Contratante.
3 — Se a concessão das prestações por doença profissional,
nos termos da legislação de um Estado Contratante,
estiver subordinada à condição de ter sido exercida, durante
um determinado período, uma actividade susceptível de
provocar tal doença, os períodos durante os quais o trabalhador
exerceu uma actividade da mesma natureza no
território do outro Estado Contratante são tidos em conta
como se essa actividade tivesse sido exercida nos termos
da legislação do primeiro Estado Contratante.
Artigo 24.º
Prestações por doença profissional no caso de exposição
ao mesmo risco no território dos dois Estados Contratantes
Sempre que o trabalhador que contraiu uma doença
profissional tenha exercido no território dos dois Estados
Contratantes uma actividade susceptível de provocar a
referida doença, nos termos das respectivas legislações,
as prestações são concedidas exclusivamente nos termos
da legislação do Estado Contratante em cujo território a
actividade tiver sido exercida em último lugar, desde que
estejam preenchidas as condições previstas na mesma
legislação, tendo em conta, se necessário, o disposto no
artigo 22.º da presente Convenção.
Artigo 25.º
Agravamento de doença profissional
Em caso de agravamento de uma doença profissional
que tenha dado lugar à concessão de prestações pecuniárias
ao abrigo da legislação de um Estado Contratante,
residindo o trabalhador no território do outro Estado Contratante,
aplicam -se as seguintes regras:
a) Se o trabalhador não tiver exercido no território do
Estado Contratante onde reside uma actividade susceptível
de provocar ou agravar a doença em causa, a instituição
competente do primeiro Estado Contratante assume o
encargo correspondente ao agravamento da doença, em
conformidade com a legislação por ela aplicada;
b) Se o trabalhador tiver exercido no território do Estado
Contratante onde reside uma actividade susceptível
de agravar a doença em causa, a instituição competente
do primeiro Estado Contratante mantém o encargo das
prestações anteriormente assumido, cabendo à instituição
competente do último Estado Contratante assumir o encargo
correspondente ao agravamento da doença.
TÍTULO IV
Disposições diversas
Artigo 26.º
Cooperação entre as autoridades e as instituições competentes
1 — As autoridades competentes dos dois Estados Contratantes:
a) Celebram os acordos administrativos necessários à
aplicação da presente Convenção;
b) Comunicam entre si as medidas tomadas para a aplicação
da presente Convenção;
c) Comunicam entre si as informações relativas às modificações
das respectivas legislações susceptíveis de afectar
a aplicação da presente Convenção;
d) Designam os respectivos organismos de ligação e
estabelecem as suas atribuições nos acordos administrativos
a que se refere a alínea a) do n.º 1 do presente artigo.
2 — Para efeitos de aplicação do disposto na presente
Convenção, as autoridades e as instituições dos dois Estados
Contratantes prestam mutuamente a colaboração
técnica e administrativa necessária gratuitamente.
3 — Os Estados Contratantes prestam ainda colaboração
técnica e administrativa, tendo em vista a atribuição de
prestações exclusivamente devidas por um Estado Contratante
a nacionais de Estados terceiros, ao abrigo de outros
acordos internacionais a que esse Estado Contratante se
encontre vinculado, fornecendo as informações necessárias
sobre a vinculação ao sistema e a carreira de seguro
dos interessados que estão ou estiveram sujeitos à sua
legislação, nos termos a definir em acordo administrativo,
previsto na alínea a) do n.º 1 do presente artigo.
4 — Para efeitos de aplicação do disposto na presente
Convenção, as autoridades competentes e as instituições
dos dois Estados Contratantes podem comunicar directamente
entre si ou por via diplomática, bem como com as
pessoas interessadas ou os seus representantes.
5 — Para efeitos de aplicação do disposto na presente
Convenção, as autoridades competentes e as instituições
dos dois Estados Contratantes correspondem -se em língua
inglesa.
Artigo 27.º
Protecção de dados pessoais
1 — A comunicação de dados pessoais entre autoridades
ou instituições dos Estados Contratantes, ao abrigo da presente
Convenção ou dos acordos administrativos previstos
na alínea a) do n.º 1 do artigo 25.º da presente Convenção,
está sujeita à legislação em matéria de protecção de dados
do Estado Contratante que os transmite.
2 — A comunicação, registo, alteração e destruição de
dados por parte da autoridade ou da instituição do Estado
Contratante que os recebe, estão sujeitos à legislação em
matéria de protecção de dados desse Estado Contratante.
3 — Sem prejuízo dos n.os 1 e 2, a cooperação entre
as autoridades ou instituições competentes dos Estados
Contratantes está ainda sujeita às normas de direito internacional
vigentes nesta matéria, devendo os dados a
comunicar ser adequados, pertinentes e não excessivos
relativamente às finalidades a que se destinam.
Artigo 28.º
Isenções ou reduções de taxas e dispensa de legalização
1 — O benefício das isenções ou reduções de taxas,
selos, emolumentos notariais ou de registo, previsto na
legislação de um Estado Contratante em relação a quaisquer
actos ou documentos a apresentar em aplicação da
legislação desse Estado Contratante, aplica -se a quaisquer
actos ou documentos análogos que forem apresentados nos
termos da legislação do outro Estado Contratante ou das
disposições da presente Convenção.
2 — Os actos e documentos a apresentar para efeitos da
presente Convenção são dispensados de legalização das
autoridades diplomáticas e consulares.
Artigo 29.º
Apresentação de pedidos, declarações ou recursos
1 — Os pedidos, declarações ou recursos que devam
ser apresentados, nos termos da legislação de um Estado
Contratante, num determinado prazo, a uma autoridade,
instituição ou órgão jurisdicional desse Estado Contratante,
são admissíveis se forem apresentados no mesmo prazo a
uma autoridade, instituição ou órgão jurisdicional correspondente
do outro Estado Contratante.
2 — Nos casos referidos no n.º 1 do presente artigo, a
autoridade, instituição ou órgão jurisdicional que tenha
recebido o pedido, declaração ou recurso transmite -o sem
demora à autoridade, instituição ou órgão jurisdicional do
primeiro Estado Contratante.
Artigo 30.º
Transferência de um Estado Contratante
para o outro de quantias devidas em aplicação da Convenção
1 — As instituições de um Estado Contratante que, nos
termos das disposições da presente Convenção, sejam
devedoras de prestações pecuniárias a beneficiários que
se encontrem no território do outro Estado Contratante
desoneram -se validamente do encargo daquelas prestações
em euros.
2 — As quantias devidas a instituições de um Estado
Contratante devem ser liquidadas em euros.
Artigo 31.º
Direitos das instituições devedoras contra terceiros responsáveis
Se, nos termos da legislação de um Estado Contratante,
uma pessoa beneficiar de prestações em resultado de um
dano sofrido por factos ocorridos no território do outro
Estado Contratante, os eventuais direitos da instituição
devedora contra o terceiro responsável pela reparação do
dano são regulados nos termos seguintes:
a) Quando a instituição devedora estiver sub -rogada,
nos termos da legislação por ela aplicada, nos direitos
que o beneficiário detém contra o terceiro, cada Estado
Contratante reconhece tal sub -rogação;
b) Quando a instituição devedora tiver um direito directo
contra o terceiro, cada Estado Contratante reconhece esse
direito.
Artigo 32.º
Compensação de adiantamentos
1 — Quando a instituição competente de um Estado
Contratante tenha pago um adiantamento ao titular das
prestações, tal instituição pode pedir, se necessário, à
instituição competente do outro Estado Contratante que
deduza esse adiantamento nos pagamentos a que o titular
tenha direito.
2 — Esta última instituição procede à dedução, nas
condições e limites previstos para uma tal compensação na
legislação por ela aplicada, e transfere o montante deduzido
para a instituição credora.
Artigo 33.º
Recuperação do indevido
1 — Se a instituição competente de um Estado Contratante
tiver pago a um beneficiário de prestações, em
aplicação das disposições do capítulo II do título III da
presente Convenção, uma quantia que exceda aquela a que
este tem direito, essa instituição, nas condições e limites
previstos na legislação por ela aplicada, pode pedir à instituição
competente do outro Estado Contratante, devedora
de prestações em favor de tal beneficiário, para deduzir o
montante pago em excesso nas quantias que esta instituição
paga ao referido beneficiário.
2 — Esta última instituição procede à dedução, nas
condições e limites previstos para uma tal compensação na
legislação por ela aplicada, como se se tratasse de quantias
pagas em excesso por ela própria e transfere o montante
deduzido para a instituição credora.
Artigo 34.º
Cobrança de contribuições e de quantias indevidamente pagas
1 — A cobrança de contribuições devidas a uma instituição
competente de um dos Estados Contratantes e de
quantias indevidamente pagas, sempre que o recurso ao
disposto no artigo 33.º da presente Convenção não seja
possível, pode ser efectuada no território do outro Estado
Contratante pelo processo e com as garantias e privilégios
vigentes no território deste último, aplicáveis à cobrança
de contribuições devidas a uma instituição correspondente
deste último Estado Contratante e de quantias indevidamente
pagas por uma instituição competente do mesmo
Estado Contratante.
2 — As modalidades de aplicação deste artigo podem
ser fixadas por acordo administrativo.
TÍTULO V
Disposições transitórias e finais
Artigo 35.º
Aplicação no tempo
A presente Convenção não confere qualquer direito a
uma prestação em relação a um período anterior à data da
sua entrada em vigor, salvo nos seguintes casos:
a) Qualquer período de seguro cumprido nos termos
da legislação de um Estado Contratante, antes da entrada
em vigor da presente Convenção, é tido em conta para a
determinação do direito a prestações, em conformidade
com o disposto na presente Convenção;
b) Sem prejuízo do disposto no presente artigo, é devida
uma prestação nos termos da presente Convenção, mesmo
que se refira a uma eventualidade ocorrida antes da data
da sua entrada em vigor;
c) Qualquer prestação que não tenha sido liquidada ou
que tenha sido suspensa em razão da nacionalidade ou da
residência do interessado é, a seu pedido, liquidada ou
restabelecida com efeitos a partir da data de entrada em
vigor da presente Convenção;
d) O disposto na legislação dos Estados Contratantes
sobre caducidade e prescrição dos direitos não é oponível
aos interessados, em relação aos direitos resultantes da
aplicação da alínea c) do presente artigo, se o pedido for
apresentado no prazo de dois anos a contar da data de
entrada em vigor da presente Convenção;
e) No caso de o pedido referido na alínea anterior ser
apresentado após o termo desse prazo, o direito às prestações
que não tenha caducado ou prescrito é adquirido
a partir da data do pedido, sem prejuízo da aplicação de
disposições mais favoráveis da legislação de um Estado
Contratante.
Artigo 36.º
Resolução de controvérsias
1 — Qualquer controvérsia que venha a surgir entre os
Estados Contratantes sobre a interpretação ou a aplicação
da presente Convenção é resolvida por negociação.
2 — Se a controvérsia não puder ser resolvida em conformidade
com o número anterior, no prazo de seis meses,
é submetida a uma comissão arbitral, cuja composição e
funcionamento são aprovados, por comum acordo, pelos
Estados Contratantes.
3 — As decisões da comissão arbitral são obrigatórias
e definitivas.
Artigo 37.º
Entrada em vigor
A presente Convenção entra em vigor no 1.º dia do 2.º
mês seguinte à data de recepção da última notificação,
por escrito e por via diplomática, de que foram cumpridos
todos os requisitos de direito interno dos Estados Contratantes
para o efeito.
Artigo 38.º
Vigência e denúncia
1 — A presente Convenção vigora pelo período de um
ano, tacitamente renovável por sucessivos períodos de
igual duração.
2 — A Convenção pode ser denunciada por qualquer
dos Estados Contratantes, devendo a notificação de denúncia
ser apresentada, por escrito e por via diplomática,
ao outro Estado Contratante até seis meses antes do termo
do ano civil em curso, cessando a vigência da Convenção
no final desse ano.
3 — Em caso de denúncia da presente Convenção, são
mantidos os direitos adquiridos e em curso de aquisição,
em conformidade com as suas disposições.
Artigo 39.º
Registo
O Estado Contratante em cujo território a presente Convenção
for assinada, submetê -la -á para registo junto do
Secretariado das Nações Unidas, nos termos do artigo 102.º
da Carta das Nações Unidas, devendo, igualmente, notificar
o outro Estado Contratante da conclusão deste procedimento
e indicar -lhe o número de registo atribuído.
Em fé do que os abaixo assinados, devidamente autorizados
para este efeito, assinaram a presente Convenção.
Feita em Lisboa, a 7 de Julho de 2009, em dois exemplares
redigidos nas línguas portuguesa, ucraniana e inglesa,
fazendo todos os textos igualmente fé. Em caso de
divergência de interpretação entre as versões portuguesa
e ucraniana, prevalece a versão inglesa.

AGREEMENT ON SOCIAL SECURITY
BETWEEN THE PORTUGUESE REPUBLIC AND UKRAINE
The Portuguese Republic and Ukraine (hereinafter «the
Contracting States»);
Desirous to develop their relations in matters of social
security;
Enshrining the principles of equality of treatment and
determination of the legislation applicable with a view
to guaranteeing to the respective nationals their acquired
rights and the rights in course of acquisition:
Have agreed as follows:
TITLE I
General provisions
Article 1
Definitions
1 — For the purposes of this Agreement:
a) «Territory» means:
i) In relation to the Portuguese Republic, the territory
in the European continent and the archipelagos of Azores
and Madeira;
ii) In relation to Ukraine, the territory within the existing
boundaries;
b) «National» means a person treated as such under the
legislation of the Contracting States;
c) «Refugee» has the meaning assigned to it in article 1
of the Convention relating to the Status of Refugees, adopted
in Geneva, on 28 July 1951 and in article 1 paragraph 2
of the Additional Protocol relating to the Status of Refugees,
adopted in New York, on 31 January 1967;
d) «Stateless person» has the meaning assigned to it in
article 1 of the Convention relating to the Status of Stateless
Persons, adopted in New York, on 28 September 1954;
e) «Worker» means the employed or self employed person
who is covered by the schemes referred to in article 4
of this Agreement;
f) «Member of the family» means any person defined
or recognised such by the legislation under which benefits
are provided;
g) «Survivor» means any person defined as such by the
legislation under which the benefits or survivors’ pensions
are provided;
h) «Residence» means the place where a person habitually
resides;
i) «Stay» means the place of temporary residence;
j) «Legislation» means the laws and other legal provisions
in force relating to the schemes or systems referred
to in article 4 of this Agreement;
l) «Competent authority» means:
i) In relation to the Portuguese Republic, the member or
members of the Government or any other corresponding
authority responsible for the matters referred to in article 4
of this Agreement in all or any part of its territory;
ii) In relation to Ukraine, the specifically designated
central organism of the executive power in what concerns
labour and social policy;
m) «Competent institution» means:
i) In relation to the Portuguese Republic, the institution
with which the person concerned is insured at the time
of the application for the benefits, or the institution from
which the person concerned is or would be entitled to
benefits if he resided in the Contracting State in which the
institution is situated, or the institution designated by the
competent authority of the Party concerned;
ii) In relation to Ukraine, the institution or institutions
responsible for granting benefits or pensions according the
legislation mentioned in subparagraph b) of paragraph 1
of article 4 of this Agreement;
n) «Institution of the place of residence» means the institution
which is competent to provide benefits in the place
where the person concerned resides in accordance with
the legislation administered by that institution or, where
no such institution exists, the institution designated by the
competent authority of the Contracting State concerned;
o) «Institution of the place of stay» means the institution
which is competent to provide benefits in the place where
the person concerned is staying in accordance with the
legislation administered by that institution or, where no
such institution exists, the institution designated by the
competent authority of the Contracting State concerned;
p) «Competent State» means the Contracting State in
which the competent institution is situated;
q) «Periods of insurance» means periods of contribution
or periods of employment or self -employment as defined or
recognized as periods of insurance by the legislation under
which they were completed, as well as all periods treated
as such, where they are regarded by the said legislation as
equivalent to periods of insurance;
r) «Benefits» and «pensions» mean any benefits, including
namely all elements thereof, as well as increases,
revaluation allowances or supplementary allowances and
lump -sum benefits which can be paid in lieu thereof under
the legislation of either Contracting State;
s) «Death grant» means any one -off payment in the
event of death under the legislation of either Contracting
State excluding the lump -sum benefits referred to in
subparagraph r).
2 — Other terms and expressions, which are used in this
Agreement, shall have the meanings respectively assigned
to them in the legislation applicable.
Article 2
Personal scope
This Agreement shall apply to the persons who are or
have been subject to the legislation mentioned in article 4
and who are nationals of one of the Contracting States,
stateless persons or refugees residing in the territory of one
of those Contracting States, as well as to the members of
their family and their survivors, as well as to those whose
rights derive from them.
Article 3
Equality of treatment
Subject to the provisions of this Agreement, the persons
mentioned in article 2 residing in the territory of one
Contracting State shall enjoy the benefits and be subject
to the obligations provided for in the respective legislation
under the same conditions as the nationals of that
Contracting State.
Article 4
Material scope
1 — This Agreement shall apply:
a) In relation to the Portuguese Republic:
i) As to the social security system, to the legislation
concerning the social security schemes applicable to most
employed and self -employed persons and the optional
affiliation schemes of the insurance system, as it regards
benefits granted, in the contingencies of sickness, maternity,
paternity, and adoption; occupational diseases;
unemployment; invalidity, old -age and death;
ii) The scheme applicable to family expenses benefits
of the family protection subsystem of the citizenship social
protection system;
iii) The compensation scheme for the damages resulting
from accidents at work;
b) In relation to Ukraine:
i) To the legislation on social insurance related to sickness
(temporary incapacity for work); pregnancy and
delivery (maternity); funeral allowance; accidents at work
and occupational diseases and/or death resulting thereof;
unemployment; age pension, invalidity pension, survivors’
pension, pension for length of service, according to the legislation
regarding compulsory public insurance on pensions;
ii) To the legislation concerning state allowances for
families with children in case of childbirth and child care
up to 3 years of age.
2 — This Agreement shall also apply to all laws and
other legal provisions that amend and complete the legislation
referred to in paragraph 1.
3 — However, it shall only apply to:
a) The laws and other legal provisions concerning a
new branch of social security if so established in an agreement
for that purpose concluded between the Contracting
States;
b) The laws and other legal provisions that extend the
existing legislation to new categories of beneficiaries,
through a notification by writing to the Contracting State
within three months from the date of the official publication
of those provisions.
4 — This Agreement shall not apply to social assistance
nor, subject to the provisions of article 9, paragraph 8:
a) In the Portuguese Republic, to the special schemes
for civil servants and persons treated as such;
b) In Ukraine, to the pensions established by especial
legislation and financed by the State Budget of Ukraine.
Article 5
Admission to social voluntary or optional continued insurance
1 — For the purposes of admission to social voluntary
or optional insurance according to the legislation of one
Contracting State, the periods of insurance completed under
the legislation of the other Contracting State shall be
taken into account, if necessary, insofar as they do not
overlap.
2 — Paragraph 1 shall only apply to a person who cannot
be covered by the compulsory insurance under the
legislation of either Contracting State.
Article 6
Residence conditions
1 — Subject to the provisions of title III of this Agreement,
benefits in the contingencies of sickness, maternity,
paternity and adoption, invalidity, for length of service,
old -age, survivors pension, as well as accidents at work
or occupational diseases and death resulting thereof, and
death grants, acquired under the legislation of a Contracting
State shall be directly paid to the persons concerned even
if they reside in the territory of the other Contracting State.
2 — The benefits mentioned in paragraph 1 shall not be
subject to any reduction, suspension or withdrawal because
of the fact that the person concerned resides in the territory
of the other Contracting State.
Article 7
Prevention of overlapping of benefits
1 — This Agreement shall neither confer nor maintain
the right under the legislation of both Contracting States
to several benefits of the same kind.
2 — Paragraph 1 shall not apply to the benefits awarded
in accordance with articles 15 and 16 of this Agreement.
3 — The provisions for reduction, suspension or withdrawal
of benefits provided for in the legislation of one
Contracting State in cases of overlapping with other benefits
or other income, including that resulting from an occupational
activity may be invoked against the beneficiary
even in the case of benefits acquired under the legislation
of the other Contracting State or of income received in the
territory of the latter Contracting State.
TITLE II
Determination of the legislation applicable
Article 8
General rule
Subject to the provisions of articles 9 to 11, the workers
who pursue an occupational activity in the territory of
one Contracting State is subject to the legislation of that
Contracting State, even if he resides in the territory of the
other Contracting State or if his employer or undertaking
has the registered office or domicile in the territory of the
other Contracting State.
Article 9
Special rules
1 — A person employed in the territory of one Contracting
State by an undertaking to which he is normally
attached who is posted by that undertaking to the territory
of the other Contracting State to perform work there for
that undertaking shall continue to be subject to the legislation
of the former Contracting State, provided that the
anticipated duration of that work does not exceed twelve
months and that he is not sent to replace another person
who has completed his term of posting.
2 — If the duration of the work referred to in paragraph 1
extends beyond the duration originally anticipated, owing
to unforeseeable circumstances, the legislation of the former
Contracting State shall continue to apply for a maximum
period of twelve months, provided that the comDiário
petent authority or the body designated by that authority
of the other Contracting State gives its previous consent.
3 — A person who is employed in the territory of a
Contracting State and self -employed in the territory of the
other Contracting State shall be subject to the legislation
of the first Contracting State.
4 — A person who is self -employed in the territory of a
Contracting State and who provides services on his own in
the territory of the other Contracting State, shall be subject
to the legislation of the first Contracting State provided that
such activity has a direct relation with the one he usually
performs and does not exceed six months.
5 — A worker who belongs to the travelling or flying
personnel of an undertaking which, on its own account or
for hire or reward, operates international transport services
for passengers or goods by rail, road, air or waterway, or of
a sea -fishery undertaking, shall be subject to the legislation
of the Contracting State in whose territory the registered
office is situated, whatever the Contracting State where
he resides.
6 — A worker who belongs to the crew of a vessel flying
the flag of a third State shall be subject to legislation of the
Contracting State in whose territory the undertaking has
its registered office or, if the undertaking has no registered
office in one of the Contracting States, to the legislation
of the Contracting State in whose territory it has a branch
or permanent representation.
7 — A worker who is employed for the purpose of loading,
unloading, carrying out repair work or performing
guard duty on board a vessel belonging to an undertaking
that has its registered office in the territory of a Contracting
State, and who does not belong to the crew of that vessel,
shall be subject, during the vessel’s stay in the territorial
waters or at a port of the other Contracting State, to the
legislation of the latter Contracting State.
8 — Civil servants or persons treated as such who are
sent from a Contracting State to the other Contracting
State shall be subject to the legislation of the former Contracting
State.
Article 10
Special rules applicable to persons
employed by diplomatic missions or consular posts
1 — Subject to paragraphs 2 and 3, the members of
diplomatic missions or consular posts shall be subject
to the provisions of the Convention on Diplomatic Relations,
adopted in Vienna, on 18 April 1961, and of the
Convention on Consular Relations, adopted in Vienna, on
24 April 1963.
2 — The technical and administrative staff and the auxiliary
staff of the diplomatic missions and consular posts
of the Contracting States, as well as the private domestic
staff of agents of such missions or posts who are not civil
servants shall be subject to the legislation of the Contracting
State in whose territory they are employed.
3 — The workers mentioned in paragraph 2 who are
nationals of the Contracting State represented by the diplomatic
mission or consular post concerned may opt to
be subject to the legislation of that Contracting State. That
right of option may be exercised once only within one year
as from the date of the entry into force of this Agreement,
or within six months from the beginning of that activity,
as the case may be.
Article 11
Exception to the provisions of articles 8 to 10
The competent authorities of either Contracting State, or
the bodies designated by them, may by common agreement
provide for exceptions to the provisions of articles 8 to 10
in the interest of certain workers or of certain categories
of workers.
TITLE III
Special provisions relating to the different kinds
of benefits
CHAPTER I
Sickness and maternity, paternity and adoption
cash benefits
Article 12
Aggregation of periods of insurance
Where a worker has been continuously or non continuously
subject to the legislation of the two Contracting
States, the periods of insurance completed under the legislation
of each Contracting State shall be taken into account,
where necessary, by the other Contracting State for the
acquisition, retention or recovery of the right to the benefits
provided for in this chapter as if they have been completed
under its legislation, insofar as they do not overlap.
Article 13
Residence in a Contracting State other than the competent one
A worker residing in the territory of a Contracting State
other than the competent one who satisfies the conditions
required under the legislation of the competent State,
taking account where appropriate of the provisions of
article 12, shall receive benefits in the Contracting State
of residence.
Article 14
Overlapping of rights to cash benefits
Where a worker is entitled to sickness or maternity, paternity
and adoption cash benefits under the legislation of
either Contracting State by application of this chapter, the
legislation of the Contracting State where the contingency
materialised shall apply.
CHAPTER II
Invalidity, old age and survivors’ pensions,
benefits for length of service and death benefits
SECTION I
Invalidity and old age and survivors’ pensions
and pensions for length of service
Article 15
Aggregation of periods of insurance
1 — Where a worker has been continuously or non
continuously subject to the legislation of the two Contrac1436
ting States, the periods of insurance completed under the
legislation of each Contracting State shall be taken into
account, where necessary, by the other Contracting State
for the acquisition, retention or recovery of the right to
the pensions provided for in this section as if they have
been completed under its legislation, insofar as they do
not overlap.
2 — Where the legislation of one Contracting State
makes the granting of certain pensions conditional upon
the periods of insurance having been completed in an occupation
or activity subject to a special social insurance
scheme, periods completed in the other Contracting State
shall be taken into account only if completed under a corresponding
special scheme or, failing that, in the same
occupation or activity.
3 — Where, account having been taken of the periods
completed in accordance with paragraph 2, the person
concerned does not satisfy the conditions for receipt of such
pensions, those periods shall be taken into account for the
granting of pensions under the general scheme.
4 — For the purposes of paragraph 1, account shall
be taken of the periods of insurance completed under the
legislation of one Contracting State other than those mentioned
in article 4 provided that they have been considered
as periods of insurance under a legislation covered by this
Agreement.
5 — Where, account having been taken of the aggregated
periods of insurance completed under the legislation
of both Contracting States, as provided for in this article,
no right to pension is acquired, account shall be taken of
periods of insurance completed under the legislation of a
third State to which both Contracting States are bound by
an international agreement on social security that provides
for the aggregation of periods.
Article 16
Calculation and award of pensions
1 — The competent institution of either Contracting
State shall determine whether the person concerned satisfies
the conditions for entitlement to pensions account being
taken, where necessary, of the provisions of article 15.
2 — Where the person concerned satisfies such conditions,
the competent institution shall calculate the amount
of the pension solely and directly on the basis of the periods
of insurance completed under the legislation that it
administers.
3 — The competent institution of the Contracting State
that provides the pensions under paragraph 2 shall take
solely into account the remunerations received by the person
concerned in the territory of that Contracting State.
4 — Where the total duration of the periods of insurance
completed under the legislation of either Contracting
State is less than a year and where no right to pensions
was acquired under that legislation on the basis solely of
those periods, the competent institution of that Contracting
State shall not be bound to grant pensions in respect to
those periods.
5 — Subject to paragraph 4, the said periods of insurance
shall be taken into account by the competent institution
of the other Contracting State as if they had been
completed under its own legislation.
6 — Where the total of the pensions payable by the
competent institutions of the two Contracting States is
less than the minimum amount established by the legislation
of the Contracting State in whose territory the person
concerned resides, the competent institution of that Contracting
State shall pay him, for the period of residence in
its territory, a supplement equal to the difference between
both amounts.
SECTION II
Death grants
Article 17
Aggregation of periods of insurance and provision of death grants
1 — Where a deceased worker has been continuously
or non continuously subject to the legislation of the two
Contracting States, the periods of insurance completed under
the legislation of each Contracting State shall be taken
into account, where necessary, by the other Contracting
State for the acquisition, retention or recovery of the right
to the death grants as if they have been completed under
its legislation, insofar as they do not overlap.
2 — If the legislation of either Contracting State makes
the provision of death grant conditional upon death has
occurred in its territory, this condition is deemed to be
satisfied where death has occurred in the territory of the
other Contracting State or of a third State to which both
Contracting States are bound by an international agreement
on social security, subject to more favourable provisions
of the applicable legislation.
CHAPTER III
Unemployment benefits
Article 18
Aggregation of periods of insurance and provision of benefits
1 — A worker who moves from the territory of a Contracting
State to the territory of the other Contracting State
shall be entitled, during his stay in the territory of the latter
Contracting State, and after having been occupied there, to
unemployment benefits as provided for in the legislation of
that Contracting State, if the eligibility conditions are met.
The periods of insurance completed under the legislation
of the former Contracting State shall be taken into account,
where necessary, insofar as they do not overlap.
2 — The competent institution of the Contracting State
that provides the unemployment benefits under paragraph 1
shall take solely into account the salary received by the
person concerned during his last employment in the territory
of that Contracting State.
CHAPTER IV
Family benefits
Article 19
Aggregation of periods of insurance
Where a worker has been continuously or non continuously
subject to the legislation of the two Contracting
States, the periods of insurance completed under the legislation
of each Contracting State shall be taken into account,
where necessary, by the other Contracting State for the
acquisition, retention or recovery of the right to the benefits
provided for in this chapter as if they have been completed
under its legislation, insofar as they do not overlap.
Article 20
Provision of benefits
1 — The portuguese nationals who pursue an occupational
activity in Ukraine and are covered by the Ukrainian
legislation shall be entitled, in respect of the members of
their family residing in Ukraine, to the state allowances
for families with children under the terms provided for in
that legislation, under the same conditions as the Ukrainian
nationals, insofar as they satisfy the respective eligibility
conditions.
2 — The krainian nationals who pursue an occupational
activity in the Portuguese Republic and are covered by
the Portuguese legislation shall be entitled, in respect of
the members of their family residing in the Portuguese
Republic, to the family allowance for children and young
people provided for in that legislation, under the same
conditions as the Portuguese nationals, insofar as they
satisfy the respective eligibility conditions.
3 — Paragraphs 1 and 2 shall equally apply to pensioners.
4 — Where the benefits mentioned in paragraphs 1 and 2
are not used by the person to whom they should be provided
for the maintenance of the members of the family, the
competent institution shall discharge its legal obligations
by providing the said benefits directly to the natural or
legal person actually maintaining them, according to a
request properly justified.
CHAPTER V
Accidents at work and occupational diseases
Article 21
Provision of benefits
The benefits in the contingencies of accident at work,
occupational disease and/ or death resulting thereof, shall
be awarded by the competent institution of the Contracting
State to which legislation the worker is or was subject on
the date of the accident at work or the date on which the
occupational disease or death resulting thereof occurred,
insofar as the conditions required under the legislation of
that Contracting State are satisfied, taking into account,
when necessary, the periods of insurance completed under
the legislation of the Contracting State.
Article 22
Residence in the Contracting State other than the competent State
A worker residing in the territory of a Contracting State
other than the competent one who satisfies the conditions
required under the legislation of the competent State, taking
into account where necessary the periods of insurance
completed under the legislation of the other Contracting
State, shall receive accidents at work or occupational diseases
benefits due to temporary or permanent incapacity or
death provided by the competent State in the Contracting
State of residence.
Article 23
Equal treatment of facts occurred in the territory
of a Contracting State other than the competent State
1 — Where, in order to assess the degree of incapacity
in cases of accidents at work or occupational diseases, the
legislation of either Contracting State takes into account
the accidents at work and occupational diseases previously
occurred, the accidents at work and occupational diseases
occurred under the legislation of the other Contracting
State shall be taken into account as if they have occurred
under the legislation of the former Contracting State.
2 — Where the granting of benefits in respect of an
occupational disease under the legislation of either Contracting
State is subject to the condition that the disease
in question was first diagnosed within its territory, such
condition shall be deemed to be satisfied if the disease
was first diagnosed in the territory of the other Contracting
State.
3 — Where the granting of benefits in respect of an
occupational disease under the legislation of either Contracting
State is subject to the condition that an activity
liable to cause the disease in question was pursued for a
certain length of time, periods during which the worker
pursued an activity of the same kind in the territory of the
other Contracting State shall be taken into account as if
such activity had been pursued under the legislation of the
first Contracting State.
Article 24
Benefits for an occupational disease where the person concerned
has been exposed to the same risk in both Contracting States
Where a worker who has contracted an occupational
disease has pursued an activity liable to cause that disease
in the territory of both Contracting States, under the respective
legislations, the benefits shall be awarded exclusively
under the legislation of the Contracting State where the
activity was last pursued, insofar as the conditions provided
for in that legislation are satisfied, taking into account,
where necessary, the provisions of article 22.
Article 25
Aggravation of an occupational disease
In the event of aggravation of an occupational disease
for which cash benefits have been granted under the legislation
of either Contracting State to a worker residing in
the territory of the other Contracting State, the following
rules shall apply:
a) Where the worker has not pursued in the territory
of the Contracting State where he resides an occupation
liable to cause or aggravate the disease in question, the
competent institution of the former Contracting State
shall bear the cost corresponding to the aggravation of
the disease under the provisions of the legislation that it
administers;
b) Where the worker has pursued in the territory of the
Contracting State where he resides an occupation liable
to cause or aggravate the disease in question, the competent
institution of the former Contracting State shall bear
the cost of benefits previously assumed and the competent
institution of the latter Contracting State shall bear
the cost corresponding to the aggravation of the disease.
TITLE IV
Miscellaneous provisions
Article 26
Cooperation between competent authorities and institutions
1 — The competent authorities of both Contracting
States:
a) Shall conclude the administrative arrangements that
are necessary for the implementation of this Agreement;
b) Shall communicate to each other all measures taken
to implement this Agreement;
c) Shall communicate to each other all information
concerning the amendments to the respective legislation
liable to affect the implementation of this Agreement;
d) Shall designate the respective liaison bodies and
establish their tasks in the administrative arrangements
mentioned in subparagraph a), paragraph 1 of this article.
2 — For the purposes of implementing this Agreement,
the competent authorities and institutions of both Contracting
States shall lend the necessary technical and administrative
assistance free of charge.
3 — For the purposes of granting benefits exclusively
due by either Contracting State to nationals of a third
State under other international agreements binding that
Contracting State, the other Contracting State shall lend
its good offices, as well as technical and administrative
assistance, by providing the necessary information on
the affiliation and insurance record of the persons concerned
that are or have been subject to its legislation,
according to the provisions to be established in the
administrative arrangement mentioned in paragraph 1,
subparagraph a).
4 — For the purposes of implementing this Agreement,
the competent authorities or the competent institutions,
may communicate directly with one another or through
the diplomatic channels and with the persons concerned
or their representatives.
5 — For the purposes of implementing this Agreement,
the competent authorities or the competent institutions,
shall communicate in english with one another.
Article 27
Protection of personal data
1 — The communication of personal data between the
competent authorities or institutions of the Contracting
States according to this Agreement or to the administrative
arrangements mentioned in article 26, paragraph 1, subparagraph
a), shall be subject to the data protection legislation
of the Contracting State transmitting them.
2 — Any communication, storage, alteration and destruction
of the personal data by the authority or institution
of the receiving Contracting State shall be subject to the
data protection legislation of that Contracting State.
3 — Subject to paragraphs 1 and 2, the cooperation
between the competent authorities or the institutions of
the Contracting States shall also be subject to the rules in
force under the international law, and the personal data
to be communicated shall be adequate, pertinent and not
excessive in relation to the respective purposes.
Article 28
Exemptions from or reduction
of taxes and exemption from authentication
1 — Any exemption from or reduction of taxes, stamp
duty, notarial or registration fees provided for in the legislation
of either Contracting State in respect of certificates
or documents required to be produced in application of
the legislation of that Contracting State, shall apply to
similar certificates or documents required to be produced
in application of the legislation of the other Contracting
State or of the provisions this Agreement.
2 — All documents and certificates required to be produced
for the purposes of this Agreement shall be exempt
from authentication by diplomatic or consular authorities.
Article 29
Submission of claims, declarations or appeals
1 — Any claim, declaration or appeal that should have
been submitted, under the legislation of a Contracting
State, within a specific period to an authority, institution
or tribunal of that Contracting State shall be admissible if
it is submitted within the same period to a corresponding
authority, institution or tribunal of the other Contracting
State.
2 — In the cases mentioned in paragraph 1, the authority,
institution or tribunal receiving the claim, declaration
or appeal shall forward it without delay to the authority,
institution or tribunal of the other Contracting State.
Article 30
Transfers from either Contracting State to the other Contracting
State of amounts payable in application of the Agreement
1 — The institutions of either Contracting State responsible
for the payment of cash benefits under this Agreement
to beneficiaries in the territory of the other Contracting
State shall validly discharge its liability in euros.
2 — Amounts due to institutions of either Contracting
State shall be paid in euros.
Article 31
Rights of institutions responsible
for benefits against liable third parties
Where a person receives benefits under the legislation
of either Contracting State due to an injury sustained in
result of facts occurred in the territory of the other Contracting
State, any rights of the institution responsible for
providing benefits against the third party liable to provide
compensation for the injury shall be governed by the following
rules:
a) Where the institution responsible for providing benefits
is, under the legislation it applies, subrogated to the
rights which the beneficiary has against the third party,
such subrogation shall be recognised by either Contracting
State;
b) Where the institution responsible for providing benefits
has a direct right against the third party, each Contracting
State shall recognise such right.
Article 32
Recovery of advance payments
1 — Where the competent institution of either Contracting
State has made an advance payment of benefit to the
beneficiary, that institution may request, where necessary,
the competent institution of the other Contracting State
to deduct the amount of that advance payment from the
benefits payable to him.
2 — The latter institution shall deduct the amount under
the conditions and within the limits laid down by the
legislation that it administers and shall transfer the amount
so deducted to the creditor institution.
Article 33
Recovery of undue payments
1 — Where, in application of title III, chapter II, the
competent institution of either Contracting State has paid
to a beneficiary an amount in excess to that he should receive,
that institution may, under the conditions and within
the limits of the legislation that it administers, request the
competent institution of the other Contracting State to
deduct the amount overpaid from the payments due to him.
2 — The latter institution shall deduct the amount under
the conditions and within the limits laid down by the
legislation that it administers, as if the overpayment had
been made by it and shall transfer the amount so deducted
to the creditor institution.
Article 34
Collection of contributions and of undue payments
1 — The collection of contributions due to a competent
institution of either Contracting State and, in cases
where the provisions of article 33 do not apply, of amounts
unduly paid may be effected in the territory of the other
Contracting State, in accordance with the procedures and
with the guarantees and privileges in force in the territory
of the latter Contracting State, applicable to the collection
of contributions due to the corresponding institution of
this State, and of amounts unduly paid by a competent
institution of that Contracting State.
2 — The procedures for implementing this article may
be established by administrative arrangement.
TITLE V
Transitional and final provisions
Article 35
Application in time
This Agreement shall confer no rights for a period prior
to its entry into force, except in the following cases:
a) All periods of insurance completed under the legislation
of either Contracting State before the entry in force of
this Agreement shall be taken into account for determining
rights acquired under the provisions of this Agreement;
b) Subject to the provisions of this Article, a right shall
be acquired under this Agreement even though it relates
to a contingency which materialized prior to the date of
its entry into force;
c) Any benefit which has not been awarded or which has
been suspended by reasons of the nationality or place of
residence of the person concerned shall, upon application,
be awarded or resumed with effect from the date of the
entry into force of this Agreement;
d) The provisions of the legislation of the Contracting
States concerning the forfeiture or limitation of rights may
not be invoked against the persons concerned, in relation to
the rights resulting from the application of subparagraph c),
if the application is submitted within two years from the
date of entry in force of this Agreement;
e) If the application referred to in subparagraph d) is
submitted after the expiry of that period, the rights, which
have not been forfeited or time barred, shall have effect
from the date on which the application was submitted,
except where more favourable provisions of the legislation
of either Party apply.
Article 36
Settlement of disputes
1 — Any dispute over the interpretation or application
of this Agreement shall be settled, through negotiation,
through diplomatic channels.
2 — If the dispute cannot be settled in accordance with
paragraph 1 within six months, it shall be submitted to an
arbitration commission, whose composition and rules of
procedure shall be approved through mutual agreement
by the Parties.
3 — The decisions of the arbitration commission shall
be binding and definitive.
Article 37
Entry into force
This Agreement shall enter into force on the first day
of the second month after the date of receipt of the last
notification, done in writing and through diplomatic channels,
informing that the internal law requisites have been
fulfilled for that purpose by both Contracting States.
Article 38
Duration and denouncement
1 — This Agreement shall remain in force for a period
of one year, tacitly renewed by successive periods of equal
duration.
2 — Either Contracting State may denounce this Agreement,
by giving a notice of denunciation, presented, in
writing and through diplomatic channels, to the other
Contracting State up to six months before the expiry of
the calendar year, producing effects at the end of that
year.
3 — In the event of denouncement of this Agreement,
the acquired rights and the rights in course of acquisition
shall be maintained in accordance with its provisions.
Article 39
Registration
The Contracting State in whose territory this Agreement
is signed shall submit it for registration to the Secretariat
of the United Nations, under article 102 of the Charter
of The United Nations, as well as shall notify the other
Contracting State of the conclusion of this procedure and
transmit the number of the registration given.
In witness whereof, the undersigned, being duly authorised
thereto by their respective Governments, have signed
this Agreement.
Done in two copies at Lisbon, this 7th day of July 2009,
in the portuguese, ukrainian and english languages, all texts
being equally authoritative. In the event of a divergent
interpretation of the portuguese and the ukrainian texts,
the english text shall prevail.
